Company Name Search
The first step is to decide upon the name under which the Company will operate its business. It is necessary for the Company Secretary to check the in the first instance if the proposed name of the Company is available and permissible.
The SSM has discretion to reject names which are in his opinion, undesirable or too similar to an existing company or if is a name that has already been reserved. The SSM may also reject a name that the Minister of Domestic Trade and Consumer Affairs has directed should not be accepted. For example :-
- Words suggesting connections with the crown, such as "Royal" or "Imperial"
- Words suggesting connection with the State of Federal Government Department, statutory body, or authority or government agency or any municipality or other local government of Agency or any municipality or other local authority such as 'Lembaga' or 'Government'
- Words suggesting connection with any Asean, Commonwealth or foreign government or with the United Nations or other international organization or cartel such as "ASEAN" or "OPEC".
- Words suggesting connections with any policies, party, society, trade-union, cooperative society or building society.
- words that are misleading as to the identity, nature, objects or purpose of a company
- blasphemous or ofensive words
- names including a registered trade mark unless the consent of the owner of the mark is produced to the ROC.
SSM may also reject names which are :-
- Translations of companies registered under CA 1956
- Resemble of may be mistaken for the name if such companies
- Which may resemble or mistaken for a name reserved for incorporation of a new company, for registration of a foreign company or for a change of name of a company already registered.
